Terms and Conditions.

  1 General

This document establishes the General Conditions of use of the services provided through this website www.mallorcalpina.com (from here the “Agency”) reserves the right to periodically modify and update them, without obligation to notify them in advance. users. These terms and conditions, together with our privacy policy and any other written information that we inform you before confirming your reservation, form the basis of your contract with the Agency, company MALLORCALPINA AVBAL / 784. Please read them carefully, as they establish our respective rights and obligations.

By sending us your initial deposit as a reservation for organized trips with or without a guide (from here the “trip”), or in ecotourism, multi-experience or active tourism activities (from here the “activity”), or where appropriate, the full payment in last minute reservations, confirms your acceptance of the following terms and conditions, which are automatically considered incorporated into the contract, without being indicated in writing in it.

  2 Confirmation of the reservation and payment in the service trip (from two days or more)

-a. Reservation: At the time of the reservation confirmation, the consumer must pay a deposit of 25% of the total cost (minimum € 100) in the travel service, to proceed with the reservation.

-b. Reduced mobility: In the case of people with reduced mobility, before proceeding with the reservation request, they must inform the Agency of this situation, in order to assess the viability of hiring the trip according to its characteristics.

-c. Reservation Confirmation: Once we receive the deposit, we will send you a written confirmation by email, with the details of your reservation, including your itinerary or program, the start date, the total cost and when the outstanding balance is due. The reservation will have full effect only once the Agency confirms it in writing. For the confirmation, the user agrees to send proof of payment to the Agency.

-d. Late reservation: Within 30 calendar days until the start of your trip, the reservation becomes a late reservation, with the payment of the total cost of your trip to proceed with the reservation and confirmation. You can book your trip at any time up to 7 calendar days before departure, according to availability.

-e. Late booking conditions: We do not charge additional administrative charges for late bookings. However, we recommend that you book your trip well in advance to ensure that you get the best benefits in important aspects of your vacation.

-f. Minimum of people: Group travel prices are calculated with a minimum of people. In case the minimum that appears in the description of the trip is not reached, an alteration of the price or cancellation of the trip will take place. Any of the options must be communicated to travelers at least 10 days in advance.

  3 Withdrawal

Conditions of cancellation by the consumer in the travel service:

Withdrawal. At any time, the user or consumer can withdraw the services requested or contracted, having the right to a refund of the following amounts that they have paid, whether if it is the total price or the advance payment provided in the preceding section. Likewise, you must notify us of any cancellation to the customer service email info@mallorcalpina.com or through a text message via SMS or WhatsApp to the number +34 699109133. Your notification of cancellation will only be effective when we receive this notification. Unless the withdrawal occurs due to force majeure, all cancellations and no-shows are subject to the following non-refundable cancellation charges:

– More than 30 days: A penalty consisting of 25% (minimum € 100) if the withdrawal occurs more than 30 calendar days before the start date of the trip

– Between 29 and 12 days: A penalty consisting of 50% of the total cost of the trip if the withdrawal occurs between 29 and 12 calendar days before the start date of the trip

– Between 11 and 5 days: A penalty consisting of 60% of the total cost of the trip if the withdrawal occurs between 11 and 5 calendar days before the start date of the trip

– Between 4 days and 48 hours: A penalty consisting of 75% of the total cost of the trip if the withdrawal occurs between 4 calendar days and 48 hours before the start date of the trip

-Less than 48 hours: A penalty consisting of 100% of the total cost of the trip if the withdrawal occurs within 48 hours before the start date of the trip or no-show.

 

Any change such as dates, inclusion of person/s or any other change that may incur expenses and/or procedures for the Agency, once the reservation is established, may be subject to additional charges.

For these purposes, and without limitation, the death, accident or serious illness of the consumer or of any of the people with whom he lives or any similar assumption that prevents him from participating in the trip and communicating to the agency that impossibility before departure. In these cases, the user must prove these points, for example, by means of a receipt issued by a public authority. Always through official documents.

If one or more participants desist, the same penalties will be applied based on their total costs, depending on when it occurs and following the points of this same article mentioned.

4 Confirmation of the reservation and payment in the activity service (from half to a day)

a. Reservation: At the time of the reservation confirmation, the consumer must pay a deposit of 50% of the total cost of the activity / s to proceed with the reservation.

-b. Reduced mobility: In the case of people with reduced mobility, before proceeding to request the reservation, they must inform the Agency of this situation, in order to assess the viability of contracting the activity according to the characteristics of the same.

-c. Reservation confirmation: Once we receive the deposit, we will send you a written confirmation by email, with the details of your reservation, including your itinerary, the start date and time, meeting point, the total cost and when it is due. The outstanding balance. The reservation will have full effect only once the Agency confirms it in writing. For confirmation, the user agrees to send proof of payment to the Agency

-d. Late reservation: Within 9 calendar days until the start of your activity, the reservation becomes a late reservation, with the payment of the total cost of your activity to proceed with the reservation and confirmation. You can book your activity at any time up to 48 hours before departure, subject to availability.

-e. Late booking conditions: We do not charge additional administrative charges for late bookings. However, we recommend that you book your activity well in advance to ensure maximum availability.

 

  5 Withdrawal

Conditions of cancellation by the consumer in the activity service:

Withdrawal. No charges: You can cancel or change the reservation or part of it without charge, with more than 9 calendar days in advance.

Between 9 and 7 days: A penalty consisting of 25% of the total amount, if the withdrawal occurs between 9 and 7 calendar days before the start date of the activity.

Between 6 days and 48 hours: A penalty consisting of 50% of the total amount, if the withdrawal occurs between 6 calendar days and 48 hours before the start date of the activity.

Less than 48 hours: A penalty consisting of 75% of the total amount, if the withdrawal occurs within 48 hours before the start date of the activity.

No-show: A penalty consisting of 100% of the total amount, in case of no-show.

Any change that may incur expenses and/or procedures for the Agency, once the reservation is established and communicated less than 9 calendar days before the start date of the activity, may be subject to additional charges.

The Agency reserves the right to shorten, change, postpone or cancel an activity until the last moment or even once the activity has started, due to adverse weather conditions or of any other nature.   6 Cancellation of the trip or activity by the organizer

If the Agency cancels the trip or activity for reasons not attributable to the client, it must reimburse all the payments made by the client within a period not exceeding 14 calendar days from the cancellation. The Agency will not be responsible for paying any additional compensation to the traveler if the cancellation is due to:

The Agency finds it impossible to carry out the trip or activity booked due to unavoidable and extraordinary circumstances and the cancellation is notified to the client without undue delay before the start of the trip or activity.

7 Prices

The price of the trip and activity contracted on the mallorcalpina.com website is established based on the services and dates selected by the user, and will depend on the number of people included in the reservation.

It is the responsibility of the user to review the sections of the offer “the price includes” and “price does not include”, before completing the purchase process. In these, all the services included in the reservation are accurately detailed.

All prices, including the budget issued by the Agency will always be represented in Euros and with VAT included.

Payments will be made by bank transfer.

  8 Reclamations

COMPLAIN FORMS : Official complaint forms are available for you at this establishment. (Term: 3 months)

  9 Relationships with independent suppliers

We act only as intermediaries for the providers of accommodation, land and sea transport, car rental, tour guides, restaurants and activities that are not owned by the Agency, that is, providers that are independent. While we make all reasonable efforts to choose quality providers, you acknowledge and agree that we are not responsible for any loss, damage, delay, inconvenience or injury to you or your companions, participants, animals, etc. as a result of any act or omission of these providers, their employees, agents, servers or representatives.

  10 Insurance in the travel service

All customers must have compulsory travel insurance in the travel service. We recommend that it is a full insurance and includes cancellation insurance, and that it be adapted to the type of trip you are going to make.

  11 Law and jurisdiction

You understand and accept that these terms and conditions and all matters derived from them are subject to Spanish law and the exclusive jurisdiction of the Spanish courts.
